Thank you for utilizing the various services offered by CallsApp and contributing to a positive text and voice experience. We would like to clarify that when we mention “Services”, we are referring to all the services provided by CallsApp, including additional apps developed by CallsApp and third-party services powered by CallsApp’s technology.

The following Terms of Use outline the rights and obligations between you and us when using our Services. Although the language used in the Terms may appear legal (because they are), we have made an effort to present them as simply as possible to ensure that you can understand and knowingly accept these binding Terms. Please note that these Terms constitute a binding agreement between CallsApp and yourself.

By using our Services, you not only gain access to a range of excellent text and voice experiences but also agree to be bound by these Terms, which affect your rights and responsibilities. If you do not wish to be subject to these Terms (including our Privacy Policy, Cookies and Tracking Technologies Policy, DMCA Policy, and other policies found on our policies page, all of which are incorporated herein), you have the option to refrain from using our Services.

CallsApp should not be used as a substitute for your regular mobile or landline telephone service, and it does not support emergency calls to emergency services. Therefore, it is essential to make alternative communication arrangements to ensure that you can contact emergency services when necessary.

Certain features within our Services may be subject to additional terms and conditions, which you should review before using those features. It is important to understand that, similar to a standard mobile phone service, anyone who knows your phone number can call you or send you messages through our Services, and anyone you message can use the content of your messages as they wish.

Legal Capacity; Children and Minors:
If you are below the age of consent in your country and cannot form a legally binding agreement, you should only use our Service if you are an emancipated minor or have obtained the legal consent of your parent or guardian. You should only use our Service if you fully understand these Terms and can comply with them. Please note that our Services are not intended for children under the age of 13. If you are under 13, please wait until you reach the age of 13 before using our Services.

Updates to Terms:
We continually work on enhancing our Services by adding new features, and occasionally, changes in applicable laws may require us to revise and reissue these Terms. In such cases, we will post the updated Terms, and by using our Services, you consent to receive notices of these updates through our posted Terms. It is advisable to regularly review this page to stay informed about the current Terms. If you do not agree with the updated Terms, please discontinue using our Services and/or close your account. Your continued use of our Services will be considered as acceptance of any revisions made.

Accuracy of Provided Information:
To access the CallsApp Service or specific features within it, you must provide accurate and complete registration details, including your correct age. If CallsApp determines that the provided details are incorrect, outdated, or incomplete, we reserve the right to deny you access to our Services, including its resources, and to suspend or terminate your account.

Online Privacy Notice:
We value your privacy and have implemented measures to protect it. To ensure transparency regarding our information practices and your choices regarding the collection and use of your information, we provide notices explaining these aspects of our Services. You can view our Privacy Policy further on our website. If you are a citizen of the European Economic Area, you can learn about exercising your data subject rights by visiting the provided link.

Trademarks and Copyrights:
Our Services and the materials presented by CallsApp on them (referred to as “Material”) are protected by copyrights, patents, trade secrets, or other proprietary rights. Additionally, certain characters, logos, and images incorporated in our Services may be protected as registered or unregistered trademarks, trade names, and/or service marks owned by CallsApp or other parties (“Trademarks”). CallsApp or its licensors hold the title, copyright, and other intellectual property rights to the Material and Service. Your use of our Services does not grant you any ownership rights to the Service or the Materials it contains. CallsApp respects the intellectual property rights of others and expects users of our Services to do the same.

Your access and use of our Service and any content, including material, provided on it, are governed by these Terms. It is important to comply with these Terms when utilizing the Material or any other content on our Services. Any unauthorized modification or use of the Material or other content, which goes against these Terms, is strictly prohibited. Engaging in such prohibited activities not only violates these Terms but also infringes upon copyrighted and/or trademarked materials protected by law.

You are permitted to access and display the Material and all other content on our Services for non-commercial, personal, and entertainment purposes. This access is granted to any device you own or control, such as computers, tablets, smartwatches, or mobile devices. However, unless specifically authorized by CallsApp, you may not copy, reproduce, republish, upload, post, transmit, distribute, or use the Material or any other content in any other way. Decompiling, reverse engineering, disassembling, or attempting to decipher the underlying code used in any software on this Service, with the intention of examining its construction or creating similar products, is strictly prohibited. Additionally, you may not rent, lease, lend, sell, redistribute, or sublicense the Material and/or the Services.

Calling Services:
As part of our Service, we offer you the ability to make free calls to your friends who are also using CallsApp. These calls utilize your data plan unless you are connected to a Wi-Fi network. CallsApp also allows you to make calls to non-CallsApp users, including landlines and mobile numbers around the world, at rates outlined in the provided information.

Furthermore, by using the Licensed Application called “CallsApp,” you give permission for certain incoming calls, initiated outside the CallsApp network by your friends or other individuals dialing your number, to be received on your mobile device. You have the freedom to disable the ‘CallsApp’ service at any time by adjusting the application settings.

Charges for CallsApp Service and Other Features:
Calling non-CallsApp Numbers and Premium Rate Numbers with CallsApp Credit.
The rates for calling landlines and mobile phones outside the CallsApp community are determined on a per-minute basis. If a call exceeds a duration of 2 hours, it will be automatically disconnected, requiring a re-dial.

CallsApp may modify the rates for calling phones at any time. These rate changes will be posted, and the new rates will apply to your next call after the updated rates have been published. It is advisable to check the latest rates before making a call. If you do not agree with the new rates, please refrain from making the call.

Call duration is calculated in one-second increments, with fractional seconds rounded up to the next second. At the end of a call, fractional cent charges will be rounded up or down to the nearest whole cent. For example, a total call priced at $0.017 will be rounded to $0.02. During the call, charges incurred will be automatically deducted from your CallsApp Credit balance in your User Account.

The use of CallsApp is subject to our Fair Usage Principles.

Subscriptions/Calling Plans:
CallsApp provides cost-saving calling plans that specify fixed prices for designated destinations and time periods. We also offer recurring calling plans that renew periodically and function as subscriptions. These calling plans, including unlimited plans, are intended for individual use and are subject to our Fair Usage Principles, which prevent fraud and misuse. They do not cover special, premium, service, or non-geographic numbers. While the majority of CallsApp unlimited plan customers use fewer than 2000 minutes per line per month without any unusual patterns, exceeding this limit in combination with other factors that may negatively impact other CallsApp customers or the CallsApp network could be considered abnormal and unreasonable usage. In such cases, we reserve the right to terminate your subscription or offer you an alternative calling plan. We also retain the right to modify or discontinue calling plans and subscriptions at any time. If the products included in your Subscription change, we will notify you, and you will have the option to terminate the subscription. Unused minutes or credit will not carry over to the following month.

Charges for Other CallsApp Products or Features:
The prices for additional CallsApp products or features will be provided to you prior to completing a purchase. CallsApp reserves the right to change the prices of such products without notice. You can choose whether to accept the new charges before making your next purchase of the respective product. The updated prices will apply to your subsequent purchase once they have been published.

Free Trial Periods and Charges:
Occasionally, CallsApp may offer certain products or features for a trial period at no charge, at its sole discretion, with regard to duration and scope. However, if CallsApp determines, at its reasonable discretion, that you are abusing the terms of the offer, including using services, proxies, other devices, or anonymous IP addresses to prevent detection, we reserve the right to charge you for these products at the regular rate.

VAT and Other Indirect Taxes:
CallsApp may collect Value Added Tax (VAT) or other indirect taxes at the applicable rate for your specific country, in accordance with relevant tax regulations. These taxes will be levied at the time of purchasing the CallsApp Credit or when utilizing the CallsApp Credit.

Mobile Data Usage and Additional Charges:
Using the Service on mobile applications consumes some of the data allowance included in your subscribed data package with your mobile network operator. Out-of-country usage can result in significantly higher costs than regular usage, and you are solely responsible for staying informed and covering any possible roaming or additional charges imposed by your mobile network operator.

Payments and Refunds:
The default currency for purchases is USD. You can buy credits known as “CallsApp Credit” using any payment method provided by CallsApp. The purchased CallsApp Credit will be applied to your User Account immediately. An order acknowledgment will be sent to you via email. We employ third-party services to process payments, and they are required to adhere to data protection measures and legal regulations. Before providing your banking or payment details, please review the terms of use and privacy policies of these third-party services. By making payments, you acknowledge that the availability of future features or products offered through the Service is not guaranteed. To change your payment method or billing information, log into your CallsApp account and open a ticket. CallsApp may utilize the information related to your chosen payment method provided by your issuing bank or payment system. If you make a payment in a foreign currency, please be aware that the credited amount may vary due to the foreign currency conversion policies of our third-party payment processors. You can find more information about these policies on the respective website or location where you make the purchase.

If you do not use your CallsApp Credit for three months (including credits allocated by a CallsApp administrator), the credits will be frozen. You can reactivate your CallsApp Credit by logging in to your CallsApp account. If your CallsApp account is deactivated, you will lose your CallsApp Credit. Account deactivation can occur if you actively deactivate your account, remove CallsApp from your mobile device and fail to reinstall it within three months, or do not log in to CallsApp for three consecutive months.

Currently, CallsApp Credit can only be used for CallsApp external calls or SMS.

When you purchase CallsApp Credit through the CallsApp website, the automatic recurring charge feature will be enabled by default unless you uncheck the corresponding checkbox during the purchase. Whenever your CallsApp account balance falls below the threshold set by CallsApp, your CallsApp Credit balance will be recharged with the same amount and using the same payment method you initially designated when registering your account. You can disable the recurring charge feature at any time by accessing your User Account. Any currency-specific charges mentioned are merely examples and do not account for currency fluctuations or discrepancies.

Subscriptions, such as recurring calling plans, are subject to recurring payments. By agreeing to a subscription, you authorize us to charge your payment method at the applicable recurring intervals until you actively terminate the subscription.

In case of pricing or specification errors, CallsApp reserves the right to refuse or cancel any orders at its sole discretion. If your credit card or account has already been charged before cancellation, a credit for the charged amount will be issued. Additional terms may apply.

Unless otherwise required by law, all purchases are final and non-refundable. If you believe there has been an erroneous charge by CallsApp, please contact us within 90 days of the charge. Refunds will not be issued for charges older than 90 days. If you purchase digital content from CallsApp, your right to withdraw or cancel the purchase terminates once the content is delivered upon your request. In such cases, refunds can only be claimed if an error in charging occurred. If you use third-party services to purchase CallsApp external Credit, the terms of the third party regarding payment terms and refunds will apply.

CallsApp reserves the right to deny refund requests in the following circumstances: (i) suspected exploitation of the refund policy, such as repetitive refund requests for the same product or feature; (ii) violation of the terms of this License; (iii) fraudulent use of CallsApp products or fraudulent use of your User Account by a third party; or (iv) credit purchased through a third-party service that prohibits refunds. This refund policy does not affect any of your statutory rights to pursue a claim.

Public Content:
The materials, information, and opinions shared in public accounts, public chats, comment sections, community chats, or other forums on this Service (“Forums”) do not necessarily represent the views of CallsApp or its content providers. CallsApp does not actively monitor or review Forums, and the content posted there is not the responsibility of CallsApp. CallsApp retains the right to remove or modify any content in the Forums at any time, without notice or liability, at its sole discretion. Your use of the Forums is at your own risk and subject to the disclaimers and limitations on liability mentioned above.

User Content:
We encourage you to share your positive text and voice experiences through our service. To ensure a safe and enjoyable experience for you and other users, we reserve the right to remove or decline the distribution of any User Content on the Service, suspend or terminate users, and block participants of CallsApp Public Chats without incurring any liability. This applies when the User Content, at our sole discretion, violates these Terms, including House Rules, Public Account, Public Chat, Bot, Community, and VAP Terms & Guidelines, or any additional terms, or when we find it objectionable. We also reserve the right to respond to user support requests or reports received through the CallsApp App, as well as to protect the rights, property, or safety of CallsApp, its users, and the public.

Public Chats:
The Service allows users to follow Public Chats conducted on the platform. Public Chats involve conversations among groups of participants with a common interest or affiliation, publicly viewable on CallsApp. Participants, viewers, and followers of Public Chats must be at least 13 years old as some content may not be suitable for children. Please review the Public Account, Public Chat, Bot, Community, and VAP Terms & Guidelines and the Content Guidelines (included in these Terms) to understand prohibited content and terms applicable to CallsApp Public Chat. You can unfollow a CallsApp Public Chat if you find it unsuitable for any reason.

CallsApp does not actively monitor Public Chats or other Forums, and the content posted in them is not the responsibility of CallsApp.

When using our public Forums, your content becomes public and can be viewed by anyone, both on CallsApp and elsewhere, associated with you. We may use your content to enhance how we provide content to you and other users. By posting or uploading any User Content to CallsApp, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use the intellectual property rights for the publicly shared content on our Service. This license terminates when you delete the content or your account, unless users who have seen the content saved it. Removed content may be retained in backup copies for a reasonable period but will not be available to others.

Our Use of Your User Content:
Anything you provide to CallsApp, including feedback, ideas, or suggestions, or any contribution you make to this Service, will be considered available for our use without any obligations to you, including payment. We will not provide compensation for the use of your ideas or submissions under any circumstances.

Claims of Infringement:
If you believe that any materials accessible on or from the Service infringe your copyrights, you can request their removal or access restriction by contacting our copyright agent.

Responsibility for Your Use:
You may only use our Service and its contents for lawful purposes and in compliance with applicable laws. Storing, distributing, or transmitting unlawful material through this Service is strictly prohibited and may result in criminal and/or civil liability. If a third party claims that your contributed material violates the law, you are responsible for proving its lawfulness. You acknowledge that all publicly posted or privately transmitted materials on this Service are the sole responsibility of the sender, not CallsApp, and you are accountable for all the material you upload, publicly post, or transmit through this Service.

System Abuse; Bulk Messaging:
You agree not to engage in activities such as sending “mailbombs” (sending numerous copies of a single message to many users or sending large or multiple files/messages to a single user with malicious intent) or “spamming” (sending unsolicited messages for business or other purposes). Additionally, you must not send “bulk messaging” (sending messages for business or commercial purposes) without written permission from CallsApp. Any activity that negatively impacts the operation or enjoyment of this Service by others, including malware placement, is strictly prohibited.

Reproducing, selling, reselling, or exploiting any resources or access to resources on this Service is not permitted.

Security of User Accounts:
When creating a User Account and choosing a password, you are responsible for all activities performed under your User Account. If there is any unauthorized use or security breach concerning your User Account, including your password, you must notify CallsApp immediately. CallsApp will not be liable for any losses incurred due to unauthorized use of your User Account, with or without your knowledge. Furthermore, you may be held responsible for any losses incurred by CallsApp or another party as a result of unauthorized use of your User Account. CallsApp reserves the right to monitor your User Account and password and may require you to change your password if it is considered insecure. If you use a username and password that CallsApp deems insecure, CallsApp may require you to change it or terminate your User Account.

Security Violation Policy:
You are strictly prohibited from using any services or features provided with this Service to compromise security or manipulate system resources and/or accounts. It is strictly forbidden to use or distribute tools designed to compromise security, such as password-cracking programs, malware, network probing tools, or any other similar software. If you are found to be involved in any breach of system security, CallsApp reserves the right to disclose your information to system administrators at other sites, as well as law enforcement and/or governmental authorities, to assist in resolving security incidents.

While we hope you continue to have a positive experience using our Service, you have the option to terminate your relationship with CallsApp at any time. If you are using our free Service, you can simply stop using it. If you have registered for our “CallsApp external” service (as described above), you can request the deletion of your account in accordance with our cancellation policy. CallsApp retains the right to terminate your access to our Service without notice, as permitted by applicable law.

Disclaimer of warranties:
We strive to make our Service free from errors and interruptions, but we cannot guarantee flawless performance despite our best efforts. Your use of this service is at your own risk. No verbal or written information or advice provided by us shall create any warranty. The service, along with all materials, information, software, facilities, services, and other content on the site, is provided “as is” and “as available” without any warranties, either express or implied. To the fullest extent permitted by applicable law, CallsApp, its parent company CallsApp, and any subsidiaries or affiliated companies of CallsApp (collectively referred to as “the CallsApp Group”) disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The CallsApp Group does not warrant that the functions of this service will be available, uninterrupted, or error-free, that defects will be corrected, or that the service or servers making it available are free from viruses or other harmful components. The CallsApp Group does not warrant or make any representations regarding the use or results of the use of the materials, information, software, facilities, services, or other content on the service or any linked websites in terms of their accuracy, correctness, reliability, or otherwise. The CallsApp Group assumes no liability or responsibility for any errors or omissions in such materials, information, software, facilities, services, or other content of the service or any other website. If applicable law does not allow the exclusion of some or all of the above-implied warranties, the exclusions will apply to you only to the extent permitted by applicable law.

If you are accessing a United Kingdom or Luxembourg version of the service, nothing in this Agreement shall exclude or limit liability for death or personal injury resulting from the negligence of either party or their servants, agents, or employees.

Limitation of liability:
The CallsApp Group disclaims all liability, whether based on contract, tort (including negligence), strict liability, or otherwise, and shall not be held liable for any loss or damage (direct, indirect, punitive, actual, consequential, incidental, special, exemplary, or otherwise) arising from the use of, or inability to use, the service or any other site, app, or service, or the materials, information, software, facilities, services, or other content on the service or any other site, app, or service, regardless of the basis upon which liability is claimed, even if any member of the CallsApp Group has been advised of the possibility of such loss or damage. You (and not any member of the CallsApp Group) assume the entire cost of all necessary servicing, repair, or correction in the event of any such loss or damage. If applicable law does not allow all or any part of the above limitation of liability, the limitations shall apply to you only to the extent permitted by applicable law. Our total liability to you for all damages, excluding cases involving personal injury where required by applicable law, shall not exceed fifty dollars ($50.00). These limitations apply even if the stated remedy fails to fulfill its essential purpose.

You agree to indemnify and hold harmless The CallsApp GROUP from any and all claims, demands, liabilities, costs, or expenses, including reasonable attorney’s fees, arising from your breach of these Terms, including the provisions, representations, or warranties stated herein, as well as from your placement or transmission of any content on CallsApp’s servers and/or from your use of your User Account.

By having a dispute with any user (including game developers and/or merchants), you release The CallsApp GROUP from any and all claims, demands, liabilities, costs, expenses, and damages (actual and consequential, known and unknown, of every kind and nature) arising out of or in any way connected with such disputes. By entering into this release, you expressly waive any protections (whether statutory or otherwise), to the extent permitted by applicable law, that would otherwise limit the scope of this release to include only those claims that you may know or suspect to exist in your favor at the time of agreeing to this release.

CallsApp may gather information from users suspected of violating these terms, as well as from other users. CallsApp may suspend users whose conduct or postings are under investigation and may remove such materials from its servers without notice, as deemed appropriate. If CallsApp believes, at its sole discretion, that a violation of these terms has occurred, it may edit or modify any submissions, postings, or emails, permanently remove the material, cancel postings, issue warnings to users, suspend users and their passwords, terminate accounts, or take other corrective actions as deemed appropriate. CallsApp may fully cooperate with law enforcement authorities or court orders requesting or directing the disclosure of the identity of anyone posting content or making materials available that are believed to violate these terms. By accepting this agreement, you waive and hold harmless all members of the CallsApp group from any claims arising from any actions taken by any member of the CallsApp group during or as a result of investigations, and/or from any actions taken as a consequence of investigations by either a member of the CallsApp group or law enforcement authorities.

Reservation of Rights:
CallsApp retains the right to modify or discontinue, temporarily or permanently, all or any part of this Service, as well as any software, facilities, and services provided on this Service, with or without notice. CallsApp may also establish general guidelines and limitations on the use of the Service.

Compliance with Local Regulations:
We do not warrant or represent that our Service is available or permissible under the law in any specific location. If you choose to access our Service, you do so at your own initiative and are responsible for complying with any applicable laws, including but not limited to local laws. You are specifically responsible for compliance with local laws if they are applicable. You agree to comply with all applicable laws concerning the transmission of technical data exported from the United States or the country you reside in.

Third-Party Services:
This Service may contain links to other websites on the Internet and may partner with third-party entities to provide certain Services. These websites may contain information or material that some individuals may find inappropriate or offensive. These external sites are not under the control of CallsApp, and you acknowledge that CallsApp is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites. Your use of these external sites is subject to their respective terms of use. The inclusion of such links does not imply endorsement of any site by CallsApp or any association with its operators.

Third-Party Products and Services:
CallsApp cannot guarantee your satisfaction with any products or services purchased from third-party sites linked to or from CallsApp, as these third-party sites are owned and operated by independent retailers. CallsApp does not endorse the merchandise nor verify the accuracy or reliability of the information provided on such third-party sites. CallsApp does not make any representations or warranties regarding the security of any information (including credit card and personal information) you may be asked to provide to any third party, and you waive any claim against us with respect to such sites. We strongly advise you to conduct your own investigation before engaging in any online transactions with these third parties.

Proprietary Online Services:
Any area of this Service accessed through a proprietary online service is subject to the rules, policies, and guidelines of that specific service.

If any provision of these Terms is deemed unlawful, void, or unenforceable by written decision, it shall be considered separate from this agreement and shall not affect the validity and enforceability of the remaining provisions. This agreement represents the entire understanding between you and CallsApp regarding the subject matter herein and the Service.

Account Deletion:
If you wish to delete your CallsApp account, follow these simple steps.

– Open the CallsApp on your device.
– Go to the “Account” section.
– Click on the “Edit” button located at the bottom right corner of the screen.
– Select the “Delete Account” option.

Please note that deleting your account will result in the permanent removal of all associated data, including call logs, messages, and contact information. This action cannot be undone, so ensure you download any important data before proceeding.

In the event of any discrepancies between the English version of these terms and any other language version, the English version shall prevail.
